About 85 percent of Chinese white-collar workers work overtime every week, and 21.3 percent work five to 10 hours a week, according to the 2017 White-collar Satisfaction Index survey released by Zhaopin.

This year, after graduating from her master's degree, she worked in a large home furnishing company as a financier. Because of the cyclical nature of her work, she always worked overtime every month for the weekend. "The workload is heavy and the manpower is not enough."



This year marks the 24th anniversary of the two-day weekend, and for many workers, the "five-day, 40-hour week" system is still just "looking beautiful". Master Ma, a sanitation worker in Xicheng District of Beijing, told reporters that he worked about 12 hours a day. When it comes to weekend overtime, "I work overtime every week because of a tight workforce, and so do my fellow workers." He said.



"12 hours a day, there are many factories that have no weekends." In Changzhou, Jiangsu Province, Li Ping runs a small factory, he told reporters that the general factory said that there are two-day breaks, but in fact is basically empty. In factories around the world, overtime pay for workers is generally 13 yuan / hour. "When there are many orders and need to catch up, the workers must work overtime on weekends." He believes that the two-day weekend is unreasonable, but it is a practical need, "the basic wage of ordinary workers is less than 2000 yuan a month, to get higher wages, only by working overtime."



When paying overtime, the unit "jerry-built" interviews, many respondents said that even if overtime, pay overtime or make-up, employers generally "jerry-built.



In Shenyang, there is a company that says something about a labor contract. Liuxuyin, an elevator worker in a Shenyang elevator company, signed a non-scheduled labor contract with the company. He often needs to use the rest time to repair the elevator without overtime pay. When he asked his boss for overtime pay, the person in charge of the company even said: "The unit declared an irregular job, even if I let you work 24 hours a day, no overtime pay does not matter."



According to the Labor Law, the working hours should be prolonged for special reasons, and the working hours should not exceed 3 hours a day and 36 hours a month under the condition of protecting the health of workers. At the same time, if the workers are arranged to work on the rest days and can not arrange supplementary rest, they shall be paid a wage remuneration of not less than 200% of their wages. But a reporter's survey found that some employers were very casual in arranging rest and overtime pay.

"Our unit calculates overtime wages, and finds that the cost is too high, just to make up for rest." Zhang Wen, who works in a website in Beijing, said. Wang Shanshan, who often turns around, is not so lucky. She said that even if the unit was given a rest, it would not be normal to enjoy it. "The project is coming, colleagues are busy, vacation will be uneasy; even if asked to take a supplementary leave, the leadership will use various reasons to delay, drag, do not know where the holiday went."



In addition, it is also a common practice for some enterprises to pay overtime fees at the lowest level. "As a rule, overtime in January should not exceed 36 hours, but many employees, including myself, sometimes work more than 100 hours overtime in January, but eventually appear on the payroll, only 36 hours overtime pay." Anan, who works in the human resources department of a Beijing company, told reporters reluctantly.



Employee rights are often "embarrassed".



Reporters noted that in the face of their legitimate rights and interests are infringed, some employees are not unclear about the relevant policies, there is "some provisions are difficult to implement, more difficult to safeguard legitimate rights and interests" of the reality of embarrassment.



According to a survey conducted by the Financial Media Center of our newspaper, 61% of the respondents said they were afraid to defend their rights when they were in office. Among them, 56% of the respondents chose to "swallow their breath"; 5% chose to "defend their rights after leaving the office"; only 29% would claim their rights to the unit; and the proportion of complaints to the relevant departments was the least, only 10%.



"As long as employers really infringe on the rights and interests of workers, they will win the approximate rate. Then what?" In the interview, many employees confess that employers will try to give the employees who dare to defend their rights "wear shoes", and finally force the employees to resign. In this way, the employees lose their jobs. Even a number of people in the human resources industry privately admit that workers who have had rights to defend the "bottom of the case" will be eliminated in the first round of screening resumes.



In this regard, Shen Jianfeng, a professor of Law School of China Institute of Labor Relations, told the Worker's Daily that one of the deep-seated problems behind workers'fear of safeguarding their rights is the protection of workers' personal information. He suggested that relevant arbitration institutions and people's courts should conceal the relevant personal information of workers in the process of publishing relevant adjudication documents.
